Bollywood Stars Remain Silent as FDA Intensifies Crackdown on Surrogate Advertising

Mumbai: The Maharashtra Food and Drug Administration (FDA) has confirmed that Bollywood superstars Shah Rukh Khan, Ajay Devgn, and Tiger Shroff have yet to respond to formal notices issued regarding their involvement in advertisements for a controversial elaichi (cardamom) brand.

The FDA issued show-cause notices to the three actors earlier this month, alleging that their endorsements for “Vimal Elaichi” serve as a front for the prohibited promotion of pan masala and tobacco products. The regulatory body argues that by utilizing the same brand identity and aesthetics as the well-known Vimal Pan Masala line, these commercials constitute “surrogate advertising,” which is designed to mislead consumers into associating the cardamom product with the banned tobacco-based items.

The Stance of the Commissioner

Tukaram Mundhe, the FDA Commissioner, addressed the issue during a ‘Meet the Press’ event hosted by the Mumbai Press Club on Wednesday. When questioned about the lack of response from the A-list celebrities, Mundhe confirmed that the 15-day deadline provided in the August 11 notice had seen no formal feedback from the actors.

Mundhe emphasized that the regulator’s primary concern is not the act of advertising itself, but the nature of the messaging. “Whatever advertisements we see—whether in newspapers, on television, or on social media—are under our radar,” Mundhe stated. “We are watching for violations.”

Strict Enforcement Policy

The FDA’s initiative marks a significant escalation in the battle against surrogate advertising, a practice often used by tobacco and alcohol companies to bypass strict advertising regulations by promoting secondary products like mouth fresheners or soda under the same brand umbrella.

Addressing potential bias, Commissioner Mundhe made it clear that the agency’s mandate would be applied universally. He stated that the department would pursue enforcement against any food business operator found to be in breach of safety and marketing standards, regardless of the individual’s stature.

“We will take action against anyone who fails to meet prescribed standards, whether they are from the film industry, are labourers, or ordinary citizens,” he asserted.

As the situation develops, the FDA continues to encourage public participation in the enforcement process. Mundhe reminded citizens that they can submit formal complaints through the official FDA portal. Upon receiving a complaint, officials are mandated to inspect the site of the alleged violation and take appropriate legal action.

The silence from the three actors has sparked a wider conversation about the responsibility of celebrity endorsers in the face of public health regulations. For now, the FDA maintains that the investigation remains active and that all parties will be held accountable for any identified violations.
